By accessing or using XiaoqilinAPI services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. These terms constitute a legally binding agreement between you and XiaoqilinAPI.

If you do not agree with any part of these terms, you must not use our services.

XiaoqilinAPI provides a unified API gateway that offers access to:

• Over 100 AI models through a single OpenAI-compatible endpoint
• Real-time model availability and routing
• Usage analytics and monitoring tools
• Technical support through the Console

Service features, models, and capabilities may change as the platform evolves. The Console and Model Square reflect current availability.

Eligibility

• You must be at least 18 years old
• You must have the legal capacity to enter into binding contracts
• You must provide accurate and complete registration information
• You are responsible for maintaining the accuracy of your account information

Account Security

• You must maintain the confidentiality of your API keys
• Use strong passwords and enable two-factor authentication when available
• Notify us immediately if you suspect unauthorized access to your account
• You are responsible for all activities that occur under your account

Account Termination

We reserve the right to suspend or terminate your account if you violate these terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

Service Restrictions

• This service is not available to residents of mainland China. By registering, you confirm that you are not a resident of mainland China.
• This service is not available to residents of countries or regions subject to international sanctions. By registering, you confirm that you are not located in any sanctioned country or region.
• We may suspend or close accounts of users who are residents of mainland China or sanctioned countries or regions, without prior notice.

• Building and deploying applications
• Research and development activities
• Educational purposes
• Commercial projects that comply with these terms

Prohibited Uses

You must not use XiaoqilinAPI services for:

• Illegal Activities: Any purpose that violates applicable laws or regulations
• Harmful Content: Generating content that promotes violence, hate speech, harassment, or discrimination
• Misinformation: Creating or spreading deliberately false or misleading information
• Privacy Violations: Unauthorized collection, processing, or disclosure of personal data
• Child Safety: Any content or activity that exploits, harms, or endangers minors
• Spam and Abuse: Mass unsolicited communications or platform manipulation
• Malware: Creating, distributing, or facilitating malicious software
• Fraud: Deceptive practices, phishing, identity theft, or financial scams
• Circumvention: Bypassing rate limits, access controls, or security measures
• Reverse Engineering: Attempting to extract model weights, training data, or proprietary algorithms
• Reselling: Unauthorized resale or redistribution of API access is prohibited. Authorized reseller partnerships are available upon request.
• Platform Abuse: Activities that degrade service performance or availability for others
• Restricted Industries: Gambling, adult content, cryptocurrency or NFT offerings, weapons, drugs, or cross-border remittance services

AI Service Transparency

• XiaoqilinAPI is an API gateway. Responses are generated by third-party AI model providers, not by XiaoqilinAPI itself.
• AI outputs may be inaccurate, incomplete, or outdated. You are responsible for verifying important outputs before relying on them.
• You remain responsible for how you use the outputs, including compliance with applicable laws and the policies of the underlying model providers.

Content Responsibility

You are solely responsible for all content generated through your use of the API, including prompts, inputs, and outputs. You must ensure compliance with applicable laws and third-party rights.

• XiaoqilinAPI operates on a pay-as-you-go pricing model
• You must maintain sufficient prepaid credits to use the service
• Current pricing is displayed in Model Square and may change with notice
• All purchases are final and non-refundable, unless a refund is required by law or by the payment platform. We do not proactively issue refunds. Once credits are added to your account, they cannot be refunded at your request, including unused credits.
• You are responsible for monitoring your usage and account balance
• Payments are processed by our payment platform. By making a purchase, you also agree to the payment platform's terms and privacy policy. We do not store your card details.
• EU/UK withdrawal right: If you are a consumer in the EU or the UK, you have a statutory right to withdraw from a distance purchase within 14 days. Because credits are digital content provided immediately, you agree that the 14-day withdrawal right is waived once you confirm your purchase and receive immediate access to the credits.

We strive to maintain high service availability, but we do not guarantee uninterrupted access.

• We do not provide Service Level Agreement (SLA) guarantees
• Scheduled maintenance windows may be announced through the Console
• Model availability varies by account, channel, and provider status
• We are not liable for service interruptions or unavailability

The XiaoqilinAPI platform, including its software, documentation, branding, and design, is protected by intellectual property laws.

• You retain ownership of content you input into the service
• You are responsible for ensuring you have rights to use any input content
• Generated outputs are subject to the terms of the underlying model providers
• You may not use our trademarks without prior written permission

To the maximum extent permitted by law:

• XiaoqilinAPI is provided "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid in the preceding three months
• We are not responsible for the accuracy, reliability, or legality of model outputs
• You use the service at your own risk

These Terms of Service are governed by and construed in accordance with the laws of the operator's place of establishment, without regard to its conflict of law provisions.

Before taking any legal action, you agree to first contact us at [email protected] and attempt in good faith to resolve the dispute through negotiation for 30 days.

If the dispute cannot be resolved through negotiation, it shall be settled in accordance with the laws of the operator's place of establishment. This does not exclude mandatory rights and protections granted to you by the laws of your country or region of residence, where applicable.
